Our Children Need Protection

As parents, children are our most precious asset and we, as parents, have an obligation to protect them. Adults, especially when driving a car or truck, must use extra care when children are nearby. As parents, our worst nightmare is having our children run over by a car or truck.

Child Injury From Car Accidents

Five year-old Tommy was seriously injured in a Fairfax, Virginia child car accident. A driver saw Tommy playing with other kids, but didn’t slow down. Tommy impulsively ran into the street and was tragically hit by the car. The driver says it wasn’t his fault.

Children, because of their young age, often act with childish impulses, putting themselves in danger from car accidents. Virginia law requires that drivers owe a special duty to children once seeing or knowing a child is nearby. Drivers are charged with the knowledge that a child acts thoughtlessly with childish impulses and must drive with extra caution to avoid injuring the child.

The Supreme Court of Virginia, in the child injury car accident case of Sullivan v. Sutherland, 206 Va. 377, 132 S.E.2nd 920 (1965), set the standard for child safety, holding: “Ordinary care toward an adult under certain circumstances might be gross negligence toward a child under the same conditions. The driver must increase his exertions in order to avoid danger to children whom he may see, or by the exercise of reasonable care, should see, on or near the highway… When the defendant saw the child near the road it was his duty to increase his exertions to avoid injury to her. He had no right to assume that a child of tender years would exercise proper care for her own protection. He was charged with knowledge of the fact that a child acts thoughtlessly and upon childish impulses, and he was required to exercise such vigilance and precaution as the circumstances demanded.”
